SECOND APPEAL NO. 1189 OF 2004
JUDGMENT:
Plaintiff filed O.S.No.12 of 1987 on the file of District
Munsiff, Sirpur, for eviction. The trial Court decreed the
suit. The unsuccessful defendant preferred appeals vide
A.S.No.11 of 2003 (A.S.No.12 of 1996, on the file of Senior
Civil Judge, Asifabad) wherein the appellate Court had
dismissed the appeal, against which the second appeal has
been filed.
2. A memo was filed by the appellants, which reads as
follows:
"It is most specifically submitted that the appellants has filed the above second appeal against the eviction of the appellants from the suit schedule property in O.S.No.12/87 on the file of the District Munsif, Sirpur, Adilabad District, which was confirmed by III Additional District Judge FTC, Asifabad in A.S.No.11 of 2003.
After filing appeal in the High Court, the M.R.O. Kaghasnagar has issued the Proc.No.A/3307/97, dated 28.09.2023 for regulization of the dwelling houses on payment of the market value of total amount of Rs.1395/-. The appellant has paid the amount in the State Treasury, Kaghasnagar vide challan No.3939 dated 29.09.2023. As such the appeal has to be allowed.
The appellants are herewith filing the above said documents for the kind perusal of this Hon'ble Court".
3. Recording the memo filed by the appellants, as the
appellants has paid the amount in the State Treasury,
Kaghasnagar, this Court deems it appropriate to allow the
second appeal.
4. Accordingly, this second appeal is allowed. No order
as to costs.
Pending miscellaneous applications, if any, shall
stand closed.
