SECOND APPEAL No.560 of 2002
JUDGMENT:
1. On 19.09.2023, when the matter was taken up for hearing, none
appeared for both parties and therefore, the matter was directed to be
listed on 27.09.2023 under the caption "for dismissal". Again on
27.09.2023, when the matter was called, there was no representation
for the appellants and therefore, the matter was directed to be listed
on 18.10.2023. Even today, when the matter is called, there is no
representation for the learned counsel for the appellants as well as
learned counsel for the respondents, in spite of the matter being listed
under the caption "for dismissal".
2. In view of the above, it appears that the learned counsel for the
appellants is not ready to argue the case. This shows that the
appellants are not evinced any interest in prosecuting the case. The
appeal is of the year 2002.
3. In the said circumstances, this Second Appeal is dismissed for
non prosecution. No costs. Miscellaneous petitions pending, if any,
shall stand closed.
