                      SECOND APPEAL No.799 of 2010

JUDGMENT:

This Second Appeal is filed by the appellant-appellant-plaintiff

aggrieved by the judgment and decree dated 02.03.2010 passed in A.S.No.124 of

2003 by the V Additional District & Sessions Judge (FTC), Ranga Reddy District

at L.B.Nagar, confirming the judgment and decree dated 11.09.2003 passed in

O.S.No.377 of 1997 by the Principal Junior Civil Judge, Hyderabad (West &

South), Ranga Reddy District.

2. When the matter came up for hearing on 23.09.2023, learned counsel for

the appellant sought time to seek instructions from his client. The matter was

posted to 17.10.2023 under the caption 'for dismissal'. Even today also, learned

counsel for the appellant appeared virtually and reported that they have no

instructions from the clients though the matter is posted under the caption 'for

dismissal'. It appears that the appellant is not evincing any interest in proceeding

with the matter.

3. In the result, the Second Appeal is dismissed for default. No costs.

Miscellaneous petitions, if any pending shall stand closed.
