COMMON ORDER:
       This Criminal Revision Case has been filed assailing the

order dated 17.04.2023 passed in Crl.A.No.676 of 2017 on the file

of the III Additional Metropolitan Sessions Judge, Ranga Reddy

District whereby the judgment of conviction under Section 138 of

Negotiable Instruments Act, 1881 (for short "NI Act") and

sentenced to undergo simple imprisonment for a period of six

(06) months and to pay compensation of Rs.6,00,000/- in default

simple imprisonment for a period of three (03) months in

C.C.No.10 of 2017 passed by the III Special Magistrate,

Cyberabad at Hasthinapuram, Ranga Reddy District, has been

affirmed.


2.     Pending revision case, the revision petitioner/accused and

the respondent No.2/de-facto complainant filed applications with

a prayer to permit them to enter into settlement and to permit the

complainant to compound the offence and to set aside the 2 NTR,J crlrc_309_2023

impugned judgment of conviction as they have congenially settled

the disputes between them.

3. It is represented that the revision petitioner/accused is

presently serving sentence in Central Prison, Charlapally. The

respondent No.2/de-facto complainant is present in person, his

identity is verified by his Aadhar Card and certified by the counsel.

4. On interaction, the respondent No.2/de-facto complainant

has submitted that, himself and the revision petitioner have

cordially settled their issues in the revision case and he is ready to

compound the offence and has no objection to set aside the

proceedings against the revision petitioner.

5. In view of the compromise between the parties and the

dispute being personal in nature, this Court is of the considered

opinion that permitting the revision petitioner and the respondent

No.2 to resolve the issue in this revision case would be in the

interest of justice.

6. Accordingly, I.A.Nos.3, 4 and 5 of 2023 are allowed and the

offence under Section 138 of NI Act in C.C.No.10 of 2017 on the

file of the III Special Magistrate, Cyberabad at Hasthinapuram,

Ranga Reddy District, is compounded. In effect, the conviction

and sentence against the revision petitioner is set aside and he is

acquitted and set at liberty. Bail bond stands cancelled.

7. Accordingly, the Criminal Revision Case is ordered.

As a sequel, pending miscellaneous petitions if any, stands

closed.
