       THE HONOURABLE SRI JUSTICE K.SARATH

                   C.C.C.A.No.138 of 2009

JUDGMENT:

When the matter came up for hearing on 15.09.2023

there was no representation for the appellant, therefore the

matter was directed to be listed to 06.10.2023 under the

caption 'for dismissal". In spite of it, today also there is no

representation for the appellant. Therefore, this Court has

no option except to dismiss the appeal for non-

prosecution/default.

2. Accordingly, the Appeal is dismissed for non-

prosecution/default. No order as to costs.

3. Pending miscellaneous applications, if any, shall

stand dismissed.
