JUDGMENT:
When the matter came up for hearing on 01.08.2023
there was no representation for both sides, therefore the
matter was directed to be listed to 22.08.2023 under the
caption 'for dismissal". Thereafter, on 29.08.2023,
11.09.2023 and 25.09.2023, learned counsel for the
appellant seeks time and the matter was adjourned to
03.10.2023 finally under the same caption. In spite of it,
today also learned counsel representing the learned
counsel for the appellant seeks further time and his
request is rejected. Hence, this Court has no option except
to dismiss the appeal for non-prosecution/default.
2. Accordingly, the Appeal is dismissed for non-
prosecution/default. No order as to costs.
3. Pending miscellaneous applications, if any, shall
stand dismissed.
