                    SECOND APPEAL No.1286 of 2010

JUDGMENT:

This Second Appeal is filed by the appellant - appellant - plaintiff

aggrieved by the judgment and decree dated 02.03.2007 by the III Additional

Chief Judge, City Civil Court, Hyderabad, confirming the judgment and decree

passed in O.S.No.4312 of 2000 dated 10.02.2006 by the XVI Junior Civil

Judge - cum - IV Additional Rent Controller, Hyderabad.

2. When the matter came up for hearing on 08.09.2023, there was no

representation by the learned counsel for the appellant as well as the learned

counsel for the respondents. Accordingly, the matter was directed to be posted

to 10.10.2023 under the caption 'for dismissal'. Even today also, there is no

representation by the learned counsel for the appellant though the matter is

posted under the caption 'for dismissal'. It appears that the appellant is not

interested in prosecuting the matter.

3. As the appellant is not evincing any interest in proceeding with the

matter, it is considered fit to dismiss the appeal.

4. Hence, the Second Appeal is dismissed for default. No order as to

costs.

As a sequel, miscellaneous applications pending in this appeal if any,

shall stand closed.
