JUDGMENT :

None appeared for the appellant, though the matter

has been listed today under the caption 'for dismissal'. On perusal

of the proceeding sheet, it depicts that since long time the matter

has been listing under the caption 'for dismissal, the appellant

has been taking adjournments stating that the matter was going

to adjust between the parties, however, there was no progress.

Thus, it appears that the appellant is not interested to prosecute

the matter vigilantly and diligently anymore. Therefore, this appeal

is liable to be dismissed for non-prosecution.

2. Resultantly, this appeal is dismissed for non-

prosecution.
