WRIT PETITION No.27699 of 2023
ORDER:
Though the Writ Petition is coming up for admission, with
the consent of both the parties, it is disposed of at the stage of
admission.
2. Heard Sri N.Ramesh, learned counsel for the petitioner and
the learned Government Pleader for Services-II appearing for
respondents. Perused the record.
3. The grievance of the petitioner is non-consideration of his
claim for promotion to the post of Senior Assistant on the ground
of pendency of Criminal Case.
4. When the matter is taken up, it is submitted by the learned
counsel for the petitioner that the issue raised in this Writ
Petition is squarely covered by the Judgment of this Court in
W.P.No.16837 of 2021 dated 23.09.2023 which is not disputed
by the learned Government Pleader for Services-II.
5. In view of the above submissions, this Writ Petition is
disposed of directing the respondents to consider the case of the
petitioner for adhoc promotion to the post of Senior Assistant in terms of G.O.Ms.No.257 dated 10.06.1999. However, the
promotion, if any, given to the petitioner, shall be subject to the
result of the criminal case pending in C.C.No.182 of 2019 on the
file of Judicial First Class Magistrate, Siddipet. No costs.
Pending miscellaneous applications, if any, shall stand
closed.
