THE HON'BLE SRI JUSTICE P.SAM KOSHY
AND THE HON'BLE SRI JUSTICE N.TUKARAMJI
W.P. No. 4776 of 2008 ORDER:(per Hon'ble Sri Justice P.SAM KOSHY)
Heard Mr. T. Ramulu, learned counsel for the petitioner.
Perused the entire record.
2. The challenge in the present writ petition is to the Award
dated 30.01.2008 passed in Permanent Lok Adalat Case No.04
of 2007 by the learned Permanent Lok Adalat, Karimnagar.
3. Having gone through the contents of the pleadings, we are of
the considered opinion that the objections so raised by the
petitioner company would no longer sustain in the light of the
recent landmark decision of the Hon'ble Supreme Court in the case
of Canara Bank Vs. G.S. Jayarama 1, whereby, the Hon'ble
Supreme Court has emphatically held that the Permanent Lok
Adalat also have got wider power in deciding the case on merits.
4. The Writ Petition, thus in the teeth of the aforesaid judgment
of the Hon'ble Supreme Court in the case of Canara Bank (Supra),
does not survive and the same stands dismissed accordingly. No
order as to costs.
(2022) 5 ALD 57 (SC)
Consequently, miscellaneous petitions pending, if any, shall
stand closed.
