None appeared for the appellant, though the matter

has been listed today under the caption 'for dismissal'. On perusal

of the proceeding sheet, it depicts that the appellant is not

evincing any interest to proceed with the matter since long time

and even on the previous dates of hearing i.e., on 18.04.2019,

13.09.2023, 04.10.2023 and 08.11.2023, there was no

representation for the appellant. Thus, it appears that the

appellant is not interested to prosecute the matter vigilantly and

diligently anymore. Therefore, this appeal is liable to be dismissed

for non-prosecution.
