     THE HONOURABLE SMT JUSTICE P. SREE SUDHA

              APPEAL SUIT NO. 501 OF 2009

JUDGMENT:

Plaintiffs filed O.S.No.92 of 2003 on the file of Senior

Civil Judge, Khamman District, for partition. The trial Court

dismissed the suit. The unsuccessful plaintiff preferred the

present Appeal Suit before this Court.

2. Learned counsel for appellant reported no instructions

from the legal representatives of the appellant.

3. Recording the submission of the learned counsel for the

appellant, no purpose would be served in continuing the

present appeal. Accordingly the appeal suit is dismissed as

abated. No order as to costs.

Pending miscellaneous applications, if any, shall stand

closed.
