             WRIT PETITION No. 27202 of 2016

ORDER:

The present Writ Petition is filed seeking the following

relief:-

"Issue an appropriate writ order or direction more particularly one in the nature of WRIT OF MANDAMUS to declare the order of the 2nd respondent in 6A Case No.A7/254/CS/2015 dated 28-07-2016 confiscation of 100% of seized stocks of 105 Qtls of PDS rice and imposition of Penalty of 40% i.e., Rs. 50,000/- on the vehicle AP 28 TC 0286 woth Rs.2.00 Lakhs is illegal improper without any power or authority under law."

2. Heard Ms.Sunitha, learned counsel representing

Sri V.H.V.R.R.Swamy, learned counsel for the petitioner and

learned Assistant Government Pleader for Civil Supplies

appearing on behalf of respondent Nos.1 and 2.

3. During the course of hearing, learned counsel for

the petitioner fairly submits that the issue raised in this Writ

Petition is squarely covered by the judgment of this Court in

W.P.No.40429 of 2017 and batch dated 02.12.2020 and the

same is not disputed by the learned Assistant Government

Pleader for Civil Supplies.

4. In view of the above, following the aforesaid

judgment of this Court in W.P.No.40429 of 2017 and batch,

dt 02.12.2020, in terms thereof, the writ petition is allowed.

No costs.

Miscellaneous petitions pending, if any, shall stand

closed.
