WRIT PETITION No.28943 of 2014
ORDER:
This writ petition is filed to declare the action of the
respondent in calling the petitioner to the police station time and
again and threatening to open the rowdy sheet against them in
connection with Cr.No.433 of 2012 on the file of the Bowenpally
Police Station, as illegal, arbitrary and violative of Article 21 of the
Constitution of India.
2. Learned Assistant Government Pleader for Home fairly
submitted that the rowdy sheet was opened against the petitioners
in the year 2013 on the strength of a solitary case in Cr.No.433 of
2012 registered for the offences under Sections 364, 364 (A), 365,
352, 368, 109, 120(B) read with Section 149 of the Indian Penal
Code, 1860 and Section 25(1) of the Arms Act, 1959, on the file of
the Bowenpally Police Station.
3. In view of the judgment of this Court in
UMESH SINGHANIYA v. THE COMMISSIONER OF POLICE,
HYDERABAD1, the continuance of rowdy sheet against the
petitioners on the strength of a solitary case is unsustainable.

The writ petition is allowed. The respondents are directed to
forthwith close the rowdy sheet opened against the petitioners.
The miscellaneous petitions pending, if any, shall stand closed.
There shall be no order as to costs.
