Judgement Date : 15 March, 2023
THE HONOURABLE SRI JUSTICE K.SURENDER
CRIMINAL REVISION CASE No.151 OF 2020
JUDGMENT:
This revision is filed by the petitioner challenging the
Judgment dt.19.07.2017 passed by the II Additional District &
Sessions Judge, Ranga Reddy District-cum-Additional Metropolitan
Sessions Judge Court, Ranga Reddy District, Cyberabad in
Crl.A.No.652 of 2014, dismissing the appeal filed by the revision
petitioner for default without giving any findings on the order dated
08.07.2014 passed in DVC.No.4 of 2013 by the IV Metropolitan
Magistrate, Cyberabad, Ibrahimpatnam, Hyderabad, granting
maintenance to the respondents 2 and 3 herein.
2. Heard. Perused the record.
3. None appears for the revision petitioner.
4. The respondents 2 and 3 herein filed DVC case in the year
2013. Aggrieved by the order dt.08.07.2014 passed in the DVC by
the IV Metropolitan Magistrate, Cyberabad, appeal was preferred by
this petitioner herein vide Crl.A.No.652/2014. However, since the
petitioner was not arguing this case, though the respondent-wife
was present throughout the proceedings, the Sessions Judge
deemed it appropriate to dismiss the appeal.
5. Questioning the said dismissal of appeal, present revision is
filed with a delay of 823 days.
6. Sri S.Prabhakar Reddy, Learned Counsel appearing for the
respondents would submit that payments are being made in the
trial Court towards maintenance, however, some dues are still
payable. I do not find any reason to keep this revision pending.
Grievance if any can as well be agitated before the concerned
Court, where maintenance was granted.
7. Accordingly, the Criminal Revision Case is disposed off.
Miscellaneous applications pending, if any, shall stand
closed.
