WRIT PETITION NO.131 OF 2023
ORDER:-
Heard the learned counsel for the petitioner and learned Assistant
Government Pleader for Tribal Welfare.
2. With the consent of both parties, the matter is disposed of at the
stage of admission. Petitioner filed this writ petition questioning the
action of the 2nd respondent for non-disposal of the appeal filed on
02.11.2016 against the judgment and decree dated 21.09.2007 passed in
O.S. No.122 of 1996 by learned Principal Senior Civil Judge,
Kothagudem, Bhadradri-Kothagudem District.
3. The learned counsel for the petitioner fairly submits that the
petitioner has filed an appeal on 02.11.2016 before the 2nd respondent on
02.11.2016. Till date, the 2nd respondent has not passed any order in
appeal.
4. In view of the same, this writ petition is disposed of directing the 2nd
respondent to consider and dispose of the appeal filed by the petitioner on
02.11.2016 and pass appropriate orders on merits and in accordance
with law, after giving opportunity to the parties in the lis within a period
of three (3) months from the date of receipt of copy of this order.
5. Accordingly, with the above direction, the writ petition is disposed
of. No order as to costs.
Miscellaneous Petitions, if any, pending in this writ petition shall
stand closed.
