JUDGMENT:

None appears on behalf of the appellants/petitioners.

Perused the proceedings dated 30.01.2023. Inspite of specific

directions for payment of batta against respondent No.1, failed

to pay batta. Proof of service of personal notice was also not

filed. As such, on 30.01.2023, the Registry was directed to list

the matter under the caption "for dismissal" to invite the

attention of the learned counsel for the appellants. Despite

listing the matter under the caption "for dismissal" as directed,

there is no representation on behalf of the appellants.

Therefore, I find no merit to adjourn the matter in the absence

of any representation on behalf of the appellants. Accordingly,

this Appeal Suit is dismissed for default for non-prosecution.

In the circumstances of the case, there shall be no order

as to the costs. Miscellaneous applications, if any pending,

shall stands closed.
