CIVIL MISCELLANEOUS APPEAL No.221 of 2010
JUDGMENT:
1. The present Civil Miscellaneous Appeal has been directed
against order dated 14.12.2009 in I.A.No.1892 of 2008 in
O.S.No.2048 of 2008 on the file of the II Additional Senior Civil
Judge, R.R. District at L.B.Nagar, Hyderabad (hereinafter referred
to as 'Court below'). The respondents herein filed I.A.No.1892 of
2008 seeking temporary injunction over the suit schedule property
against the appellants herein. After hearing both sides, the Court
below granted temporary injunction and subsequently, it was made
permanent. Aggrieved by the same, the present appeal is filed at
the instance of the respondents/defendants therein.
2. The impugned order of injunction is not suspended till date
and almost 13 years have been completed and the respondents
herein are enjoying the said injunction order. The suit pertains to
the year 2008. Hence, this Court feels that at this belated stage
this Court cannot interfere into the impugned order. Therefore,
without going into merits and demerits of the impugned order, this
Court is inclined to direct the Court below to expedite the suit
proceedings and conclude the same within the time stipulated
hereinafter.
3. In the result, the Civil Miscellaneous Appeal is disposed of
without going into merits and demerits and also without disturbing
the impugned order, directing the Court below to conclude the suit
proceedings by the end of August, 2023. There shall be no order as
to costs. Miscellaneous petitions, if any, pending, shall stand
closed.
