JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of an
interlocutory order dated 27.04.2018 passed by the learned
Single Judge in I.A.No.1 of 2018 in W.P.M.P.No.50945 of
2017 in W.P.No.41040 of 2017.
The facts of the case reveal that the writ petition was
filed by the appellants/writ petitioners for issuance of a
direction to the respondents not to proceed ahead with the
construction of double bedroom houses and the learned
Single Judge has passed an order of status quo in respect
of Survey No.1447.
The aforesaid interim order is continuing since 2018.
Therefore, this Court is of the considered opinion that the
writ petition itself deserves to be heard at an early date.
Resultantly, without averting to the merits of the
case, the present writ appeal stands disposed of with a
request to the learned Single Judge to decide the writ
petition itself on merits at an early date.
Office is directed to list W.P.No.41040 of 2017 before
the learned Single Judge having roster on 28.03.2022, on
which date the parties shall appear before the learned
Single Judge.
The miscellaneous applications pending, if any, shall
stand closed. There shall be no order as to costs.
