WRIT APPEAL No.1407 OF 2018
JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of the order dated
01.08.2018
passed by the learned Single Judge in W.P.No.26891 of 2018.
The undisputed facts of the case reveal that the
appellant/writ petitioner came up before the learned Single
Judge stating that he has submitted a representation in respect
of mutation of certain lands and the representation is not being
decided nor any enquiry has been held in the matter. The
learned Single Judge has dismissed the writ petition.
Today also, a specific question is asked to learned counsel
for the appellant/writ petitioner whether any appeal has been
preferred against the so-called entries in the revenue records.
Learned counsel is fair enough in informing this Court that
appeal has been preferred and the same is still pending.
In the considered opinion of this Court, once an appeal
has been preferred in respect of the alleged unauthorised/illegal
entries, the appellate authority has to take an appropriate
decision in the matter in accordance with law. This Court does
not find any reason to interfere with the appellate proceedings
at this juncture.
Resultantly, the writ appeal stands dismissed.
Pending miscellaneous applications, if any, shall stand
closed. There shall be no order as to costs.
