JUDGMENT:

Heard learned counsel for the petitioner and learned counsel

for the second respondent. Perused the record.

2. Learned counsel for the second respondent has filed a memo

stating the parties herein have preferred Civil Appeal Nos.2776,

2777 and 2778 of 2022 before the Hon'ble Supreme Court against

the judgment dated 17.11.2017 passed by this court in Company

Appeal No.14 of 2016, wherein the appeal filed by respondent

Nos.1 to 3 therein against the order dated 30.05.2006 passed by the

Company Law Board was allowed, and by judgment dated

06.04.2022, the Hon'ble Supreme Court has disposed of the

appeals. It is further stated in the memo that the parties undertook

before the Hon'ble Suprme Court that they will not initiate any

further civil or criminal proceedings against each other.

3. It is submitted by learned counsel for the second respondent

that in view of the undertaking given by the parties before the

Hon'ble Apex, this matter may be closed.

4. In view of the undertaking recorded by the Hon'ble Apex

Court at paragraph 42(6) of the judgment that to put a quietus to

the entire litigation between them, the parties would not like to

initiate any further civil or criminal proceedings against each, this

criminal revision case is closed .

5. Pending miscellaneous petitions, if any, stand closed.
