JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of order dated
01.08.2018 passed in I.A.No.1 of 2018 in W.P.No.26136 of 2018 by
which the learned Single Judge has directed the respondents
therein not to dispossess the petitioners therein unless
rehabilitation and resettlement entitlements are paid under Section
38 of Act 30 of 2013.
The fact remains that the main issue is still pending before
the leaned Single Judge and therefore, the interest of justice would
be sub-served by requesting the leaned Single Judge to decide the
matter on merits at an early date.
Resultantly, the writ appeal stands allowed and the order
dated 01.08.2018 passed by the leaned Single Judge is hereby set
aside and the leaned Single Judge is requested to decide the matter
at an early date.
Office is directed to list W.P.No.26136 of 2018 along with
other connected matters before the leaned Single Judge having the
roster on 24.01.2022.
Miscellaneous petitions, if any, shall stand closed. There
shall be no order as to costs.
