COMMON JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
I.A.No.1 of 2019 has been filed seeking to condone the
delay of 1282 days in filing the present writ appeal.
The present writ appeal is arising out of an order dated
27.08.2015 passed by the learned Single Judge in
W.P.No.5310 of 2012.
The facts of the case reveal that the respondent No.3
herein/consumer has approached the Forum for Redressal of
Consumer Grievances and it was unsuccessful, against which
an appeal was preferred before the Vidyuth Ombudsman and
the appeal has been allowed by an order dated 12.12.2011.
Being aggrieved by the order of the Vidyuth Ombudsman, the
writ petition was preferred i.e., W.P.No.5310 of 2012 and the
learned Single Judge has dismissed the writ petition preferred
by the appellants.
The present writ appeal has been filed with a delay of
1282 days and the only reason assigned in paragraph 6 of the
application seeking condonation of delay is that as the
Districts were bifurcated in the State of Telangana, the file
was misplaced and therefore, the appeal could not have been
filed in time. No day to day delay has been explained in the
matter nor the affidavit reveals that any action was initiated
against the officer for not filing the appeal in time.
Resultantly, this Court does not find any reason to
condone the delay in filing the writ appeal and I.A.No.1 of
2019 is dismissed.
Consequently, the writ appeal also stands dismissed.
