JUDGMENT :
This Appeal is filed aggrieved of the judgment and decree dated
01.06.2021, passed by the XIX Senior Civil Judge, City Civil Court,
Secunderabad, in O.S.No.76 of 2018.
2. Heard learned counsel for appellant and perused the material on
record.
3. Ex facie, by going through the record, this Court finds that the
appellant herein, who has suffered decree before the trial Court, is the
tenant vide rental agreement dated 04.11.2014. Aggrieved thereby,
the present appeal is preferred.
4. When the case is called, the counsel for appellant herein has
prayed that this appeal needs to be allowed. When the Court has
given him an option to argue the matter, the Counsel has again
repeated saying that the appeal needs to be allowed. Further, the
counsel for appellant submitted that the landlord is not MSC
Educational Society represented by its Secretary Mr.M.S.Nagesh
Chanter. On the other hand, when this Court has drawn his attention
to the rental agreement between the appellant and respondent herein,
the appellant has no answer.
5. In view of the above, this Court finds that it is not a fit case to
entertain, for grant of relief sought for. Since no further argument
has been advanced in support of the appeal, this CCCA is dismissed.
However, with regard to vacating the premises, this Court grants three
months' time from today, to vacate the premises. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
