                 WRIT PETITION No.20808 of 2021
ORDER:

Heard the learned counsel for the petitioners and the learned

Government Pleader for Revenue for respondent Nos.1 to 4. With

their consent, the Writ Petition is disposed of at the stage of

admission itself.

This writ petition is filed seeking the following relief:

"...to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of respondent authorities, particularly the respondent No.4 herein in trying to issue the Patta pass books in favour of the unofficial respondent basing on the fraudulent and Ex-parte Decree and Judgment in O.S.No.260 of 2003 on the file of Junior Civil Judge at Kodad and pending suit in O.S.No.470 of 2014 (Old O.S.No.144/2006) on the file of Senior Civil Judge at Huzurnagar as illegal, arbitrary and against the principles of natural justice. Consequently, to direct the respondent authorities particularly Respondent No.4 not to issue Patta passbooks, not to change records and not to interfere into petitioners peaceful possession and enjoyment without notice, pending disposal of the above writ petition and pass such other order or orders as this Hon'ble Court may deemed fit and proper in the circumstances of the case."

Having regard to the fact that the petitioners have already

raised their objections by way of a representation before the

respondent No.4 on 16.08.2021, without going into the merits or

demerits of the case, the Writ Petition is disposed of directing the

respondent No.4-the Tahsildar, Ananthagiri Mandal, to consider

the representation made by the petitioners on 16.08.2021, before

making any changes in the Revenue Records and issuing pattadar

passbook to respondent No.4.

The miscellaneous petitions pending, if any, shall stand

closed. There shall be no order as to costs.
