WRIT PETITION No. 26654 of 2021
ORDER:
In this writ petition, the petitioner challenges the
action of the respondent No. 3 in mutating the name of
the respondent No. 4 as pattadar and issuing pattadar
pass book and entering his name in online revenue
records in respect of the land in Sy. No. 122/A & EE,
admesuring Ac.5-00 guntAs, situated in the limits of
Maddur Village, C.C. Kunta Mandal, Mahabubnagar
District.
Even though several grounds have been raised by
the petitioner, having regard to the fact that the
petitioner has already filed a civil suit being O.S. No. 53
of 2017 seeking declaration of title and injunction against
the respondent No. 4 and the same is pending
consideration on the file of Junior Civil Judge, Atmakur,
this Court is not inclined to grant any relief, as sought for
in the present writ petition. The mutation entries do not
confer any title on the person in whose name entries are
made. Ultimately, if the petitioner succeeds in the suit
filed by her, the decree is not only binding on the parties
but also the revenue authorities and they are bound to
implement the Judgment and Decree of the Court.
The writ petition fails and the same is accordingly
dismissed. However, if the petitioner is so advised, she
can file an application seeking appropriate relief before
the trial Court in the pending suit and any such
application is filed, the lower Court shall consider the
same and pass orders on merits.
Pending miscellaneous petitions, if any, shall stand
closed. There shall be no order as to costs.
