CIVIL MISCELLANEOUS APPEAL No.1404 OF 2004
JUDGMENT:
This appeal was filed on 27-04-2004 and it was admitted on 01-
02-2005. Thereafter, on 12-09-2012, though the matter was passed
over during the forenoon session at the request of learned counsel for
the appellant, none appeared for the appellant and there was no representation on his behalf and hence, the matter was directed to be listed after one week. However, on 21-09-2012 also none appeared for
the appellant and there was no representation on his behalf and again the matter was directed to be listed after one week. In spite of the
above, even today, when the matter is called, none appears for the appellant and there is no representation on his behalf.
In view of the above, it appears that the appellant has no interest
in prosecuting the appeal. In the circumstances, this Court has no option except to dismiss the appeal for default.
Therefore, the Civil Miscellaneous Appeal is dismissed for
default. The Miscellaneous Applications, if any, pending are closed.
There shall be no order as to costs.
