THE HON'BLE THE CHIEF JUSTICE SATISH CHANDRA SHARMA
AND
THE HON'BLE SRI JUSTICE T.AMARNATH GOUD
WRIT APPEAL No.537 of 2021
JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of an order dated
23.09.2021 passed in W.P.No.23088 of 2021.
The facts of the case reveal that the vehicle belonging to the
appellant was involved in a forest offence and in those
circumstances, it was seized by the Forest Department. The
appellant came up before this Court by filing a writ petition and
the learned Single Judge, keeping in view the cost of the vehicle,
has directed the respondents therein to release the vehicle, subject
to deposit of Rs.7,20,000/-.
This Court has carefully gone through the documents on
record and the value of the vehicle is Rs.58,00,000/- (ex-showroom
price).
In the considered opinion of this Court, the amount fixed by
the learned Single Judge is reasonable and no case for interference
is made out in the matter.
The Writ Appeal is accordingly dismissed. The
miscellaneous applications pending in this appeal, if any, shall
stand closed. There shall be no order as to costs.
