           CIVIL REVISION PETITION NO.982 OF 2021

ORDER:

This revision is filed aggrieved by the order dated 08.02.2021

passed in E.P.No.6 of 2021 in O.S.No.363 of 2013 on the file of the

Principal Senior Judge at Kothagudem.

O.S.No.363 of 2013 was decreed with costs on 15.07.2019 in

favour of plaintiff and against the defendant for an amount of

Rs.1,72,034/- with subsequent interest @ 12% per annum from

the date of filing of the suit till the date of decree and thereafter

interest @ 6% per annum from the date of decree till the date of

realization on principal amount of Rs.1,00,000/-. Consequently,

E.P.No.6 of 2021 was filed and on 08.02.2021, the learned Judge

directed to attach a sum of Rs.2,66,162/- from the salary of

judgment-debtor i.e. Esam Bhadramma, in monthly instalments

subject to Section 60 of CPC i.e. after exempting first Rs.1,000/-

and 2/3rd of the salary and return the remaining 1/3rd of the

salary to the Court every month until 24 months or the entire debt

is discharged, whichever is earlier to the credit of the E.P., by way

of demand draft drawn in favour of the Principal Senior Civil

Judge, Kothagdem.

Challenging the same, the present revision is filed.

During the course of arguments, learned counsel for the

petitioner has not raised any ground nor placed any material in

support of his case.

Therefore, I am of the view that the trial Court has not

committed any error or illegality in passing the impugned order.

The petitioner has not made out any ground to interfere with the

impugned order passed by the trial Court under Article 227 of the

Constitution of India.

Accordingly, the Civil Revision Petition is dismissed at the

admission stage. There shall be no order as to costs.

Miscellaneous applications, if any, pending shall stand

dismissed.
