Judgment:
This Appeal is filed assailing the Judgment and Decree
dated 25-11-1999, in O.S.No.1456 of 1997 (old O.S.No.4208/93 on the
file of III Asst. Judge, City Civil Court, Hyderabad), on the file of the
V Senior Civil Judge, Hyderabad, with respect to rejection of the relief
of mesne profits.
2. Today, learned counsel for the appellant/plaintiff represented
that as against the aforesaid Judgment and Decree, earlier an
appeal viz., C.C.C.A.No.256 of 1999 was preferred and it was dismissed
on 20-03-2009. Aggrieved thereby, Special Leave Appeal (Civil)
No.14853 of 2009 was filed and it was also dismissed on 17.07.2009.
Later, Execution Petition No.79 of 2009 was filed and it was ordered on
22.07.2010
. The present appeal is filed challenging the Judgment and
Decree dated 25-11-1999, in O.S.No.1456 of 1997 only with respect to
not awarding the mesne profits.
3. The learned counsel has filed Memo dated 21.10.2021 stating that
as the main relief of declaration and delivery of vacant possession is
granted, the appellant has instructed him not to press the present
appeal. Accordingly, the learned counsel has not pressed the appeal.
4. Considering the Memo filed by the learned counsel for the
appellants, which is taken on record, this appeal is dismissed as not
pressed. No costs. Consequently, Miscellaneous Petitions, pending if
any, stand dismissed as infructuous.
