JUDGMENT:(per The Hon'ble The Chief Justice)
None appears for the appellant even in the second round.
2. The facts of the case reveal that the present Writ Appeal has
been filed against the order dt.03.09.2021 passed in WP.No.20448
of 2021.
3. The aforesaid writ was in fact filed for quashment of criminal
proceedings pending in CC.No.2747 of 2018, and the learned Single
Judge has dismissed the Writ Petition.
4. In the light of the judgment of the Apex Court in Ram
Kishan Fauji v. State of Haryana and Ors1, no writ appeal is
maintainable in a criminal matter, i.e., arising out of the order
passed in a petition under Section 482 of Cr.P.C., or a Writ Petition
which is filed for quashment of criminal proceedings.
5. Resultantly, the admission is declined. Consequently, Writ
Appeal is dismissed.
6. As a sequel miscellaneous petitions, if any, pending shall
stand dismissed. No order as to costs.
