JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of the order
dated 30.10.2018 passed by the learned Single Judge in
W.P.No.14987 of 2002.
The facts of the case reveal that for absence of only
eight days, the respondent herein was removed from
service by an order 19.06.1997. He preferred an appeal
as well as review petition. The reviewing authority passed
an order of reversion on 20.03.2001 and the said order
was subjected to judicial scrutiny before this Court. As it
was a case of removal which was modified to that of
reversion to lower rank, the learned Single Judge has
remanded the matter back to the reviewing authority to
take appropriate decision keeping in view the fact that
the punishment awarded is shockingly disproportionate
to the guilt of the employee.
Now as the Corporation has come up in appeal, this
Court does not find reason to interfere with the order
passed by the learned Single Judge, as the matter has
been remanded back to the reviewing authority to take a
fresh decision in the matter.
The writ appeal is accordingly dismissed. The
miscellaneous applications pending in this writ appeal, if
any, shall stand closed. There shall be no order as to
costs.
