THE HON'BLE THE CHIEF JUSTICE SATISH CHANDRA SHARMA
AND
THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY
WRIT APPEAL No.694 of 2019
JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of the order
dated 29.11.2018 passed by the learned Single Judge in
W.P.No.42551 of 2016.
The facts of the case reveal that the writ petition
was filed against the Telangana State Southern Power
Distribution Company Limited by the respondent No.1
herein stating that the electricity supply has been
disconnected. An interim order was granted in the
matter. The learned Single Judge was informed that the
supply of electricity has been restored to the
manufacturing unit and in those circumstances, the writ
petition was disposed of.
The appellant before this Court is disputing the title
of the writ petitioner and his contention is that he is the
title holder of the property.
In the considered opinion of this Court, in case the
appellant is disputing the title of the property, the
remedy lies elsewhere and not before this Court.
Therefore, the present writ appeal stands disposed
of with a liberty to the appellant to take recourse to the
remedies available under the law.
The miscellaneous applications pending in this writ
appeal, if any, shall stand closed. There shall be no
order as to costs.
