JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of order dated
02.01.2019
passed in W.P.No.48113 of 2018 by the learned
Single Judge dismissing the writ petition.
The facts of the case reveal that the appellant/employee
submitted an option for transfer to various posts and she has
expressed option to nearly 300 posts. She was transferred to
one of the opted place by the employer. However, after her
transfer, as one of the vacancy arose at some other place, she
wanted her case to be considered to some other place i.e.,
MPUPS, Malleboinpally, Jadcherla Mandal, Mahabubnagar
District. She made an appeal for transfer to another place.
Her request was rejected on the ground that transfer cannot
be considered in the middle of the academic year. The
learned Single Judge has dismissed the writ petition and
liberty has already been granted to the appellant to
participate in the subsequent counselling as and when held
for transfer.
In the considered opinion of this Court, the learned
Single Judge was justified in dismissing the writ petition as
the appellant was accommodated as per her choice and
liberty has also been granted to her to again apply for transfer
as and when a notification is issued for transfer of employees
as per the transfer polity.
Accordingly, the writ appeal is dismissed.
Miscellaneous petitions, if any, shall stand closed.
There shall be no order as to costs.
