JUDGMENT:      (Per the Hon'ble the Chief Justice Satish Chandra Sharma)



        The present writ appeal is arising out of the order dated

17.07.2020 passed by the learned Single Judge in W.P.No.10538 of

2020.

        The undisputed facts of the case reveal that the petitioner in

the writ petition (respondent No.2 in the present writ appeal) was

claiming to be the owner of land admeasuring 420 square yards

situated at Temple Alwal (Alwal Municipality), Malkajgiri Mandal,

Ranga Reddy District (within the municipal limits of GHMC). He

got a registered Gift Settlement Deed dated 03.02.2016 in his

favour. His grievance was that the respondent authorities therein

were not accepting her application for grant of building permission

on the ground that her plot falls in an unapproved lay out. The

learned Single Judge has passed an order directing the respondent

Municipality therein to accept the application of the writ petitioner

for grant of building permission in terms of Memo dated

28.04.2017.

Learned Standing Counsel for GHMC appearing for the

appellants has disputed the title of the writ petitioner (respondent

No.2 in the present appeal).

However, the fact remains that the learned Single Judge has

simply directed the appellants/GHMC to decide the application.

In the considered opinion of this curt, the appellants/GHMC

shall certainly be free to pass a detailed speaking order in respect

of the application of the writ petitioner (respondent No.2 in the

present writ appeal) in accordance with law.

With the aforesaid, the writ appeal stands disposed of.

Pending miscellaneous applications, if any, shall stand

closed.
