Judgment: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present Writ Appeal is arising out of interim order
dated 28.01.2019, in I.A.No.1 of 2019 in W.P.No.1386 of 2019, by
which the learned Single Judge has granted an interim order staying
the order dated 15.03.2015, passed under the Minimum Wages Act.
1948, subject to deposit of Rs.41 lakhs by the appellant/writ
petitioner.
2. Learned counsel for the appellant has argued before this Court
that the appellant/Company has paid wages to all its employees and
settlement has also been arrived at between the parties.
3. The aforesaid fact has been brought to the notice of this Court
vide Memo dated 21.06.2019, annexed to I.A.No.4 of 2019.
4. In the considered opinion of this Court, as the main Writ
Petition is still pending before the learned Single Judge, the appellant
ought to have filed appropriate application before the Single Judge
with a prayer to modify the interim order.
5. Learned counsel for the appellant, at this stage, prays for
withdrawal of the Writ Appeal with liberty to approach the learned
Single Judge by filing appropriate application.
6. Writ Appeal is, accordingly, dismissed as withdrawn with the
aforesaid liberty.
Consequently, Interlocutory Applications pending if any stand
disposed of.
