COMMON JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)
1. Mr. A. Sanjeev Kumar, learned Special Government Pleader
appearing for the appellant in L.P.A.No.2 of 2019 and C.A.No.41 of
2018 states that since the impugned order dated 30.11.2018 has been
complied with and the building plans have been released in favour of
the respondent No.1 and further the demand of Rs.30,03,000/-
towards open space contribution charges and Rs.1,46,757/- towards
compounding fee/layout regularization charges has been dropped on
the respondent No.1 paying Rs.2,30,382/-, L.P.A.No.2 of 2019 has
been rendered infructuous.
2. He requests that in view of the aforesaid developments, the
order passed by the learned Single Judge sentencing the appellant in
the contempt case to imprisonment of four weeks and fine of
Rs.2,000/- for willful disobedience of the order dated 03.04.2018 may
be quashed and set aside.
3. Mrs. Sofiya Begum, learned counsel for the respondent states
that she has no objection to the aforesaid request made by learned
Special Government Pleader.
4. Accordingly, L.P.A.No.2 of 2019 is disposed of as not pressed.
C.A.No.41 of 2018 is disposed of by quashing and setting aside the
order dated 30.11.2018 as regards imposition of sentence of
imprisonment for four weeks and fine of Rs.2,000/-.
5. Both the appeals are disposed of along with the pending
applications, if any.
