                WRIT PETITION No.6962 of 2021

ORDER:

This Writ Petition, under Article 226 of the Constitution of

India, is filed seeking to direct respondent No.3 to comply Section

41-A notice, as contemplated under Section 41-A of the Code of

Criminal Procedure in pursuance of the Judgment of the Hon'ble

Apex Court in Arnesh Kumar v. State of Bihar and another

reported in [(2014) 8 SCC 273].

2 Heard Sri Mehdi Hussain, learned counsel for the petitioners

and Sri S.Ram Mohan, learned Assistant Government Pleader for

Home, appearing for respondent Nos.1 to 3.

3. When the matter is taken up for hearing, learned Assistant

Government Pleader for Home, on written instructions, would

submit that the Investigating Officer in Crime No.4 of 2021 has

already served notice under 41-A Cr.P.C on 14.3.2021 itself on

some of the accused and also making efforts to serve similar notice

on the petitioners herein/accused Nos.3 and 4 also.

4. Recording the said submission, this Writ Petition is closed.

Miscellaneous petitions, if any, pending shall stand closed.

No costs.
