JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)

1.     The present appeal is directed against an order dated

06.02.2020 passed by the learned Single Judge dismissing

W.P.No.1673 of 2020 filed by the appellant, who was aggrieved by

the decision taken by the respondent authorities to defer his promotion

to the post of Forest Range Officer on the ground that on the date of

consideration for promotion, no articles of charge had been served on

him.

2. On enquiring from learned counsel for the appellant, he

concedes that subsequently, the charge sheet was served on the

appellant and an enquiry was conducted and as per the

recommendations made by the Enquiry Officer, the Disciplinary

Authority had passed an order dated 20.11.2020 imposing a penalty of

withholding of one increment with cumulative effect. He submits that

in view of the subsequent events, the appellant does not wish to press

the appeal. However, learned counsel requests that the issue raised in

the present appeal may be kept open for adjudication in any case that

may arise in the future.

3. While keeping the issue raised herein open for decision in any

case that may arise in the future, the present appeal is disposed of

along with the pending applications, if any.
