JUDGMENT : (Per the Hon'ble the Chief Justice Hima Kohli)
1. Pursuant to the last order passed by this court, Mr. C.V.Bhaskar
Reddy, learned Government Pleader for Revenue states that a survey
of the area was conducted on 07.04.2021 in the presence of the
appellants and the Report has been placed on record with a copy to the
other side.
2. We may note that in the writ petition filed by the
appellants/writ petitioners they were aggrieved by the action of the
respondent No.3/Tahsildar of conducting a survey in the area and
carrying out demarcations without issuing notice to them. The said
writ petition was however dismissed with an observation that the
remedy of the writ petitioners is to challenge the said survey and not
by way of approaching the court under Article 226 of the Constitution
of India. However, in the present proceedings, an order was passed
on 08.06.2020 directing the Revenue Department to conduct a survey
of the area in accordance with law.
3. Now that the survey has been conducted, if the appellants/writ
petitioners have a grievance with regard to the same, it is for them to
seek appropriate legal recourse in accordance with law.
4. The present appeal is disposed of along with the pending
applications, if any.
