  THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM

I.A.No.1 of 2020 in/and SECOND APPEAL No. 268 of 2004

COMMON JUDGMENT:

I.A.No.1 of 2020 is filed under Order XXIII Rule 1 read

with Section 151 CPC with a prayer to record the compromise in

terms of compromise and allow the appeal in terms thereof.

Today, when the matter is taken up, the parties are present

in the Court and have produced their respective identity proofs.

They are all identified personally by the learned counsel

appearing for them. They have stated before this Court that on the

advice of the elders, they had settled the dispute among

themselves and all of them agreed that out of their own free will

and volition, they entered a memorandum of compromise, which

was reduced into writing.

In those circumstances, I.A.No.1 of 2020 is allowed as

prayed for. Consequently, S.A.No.268 of 2004 is disposed of in

terms of the compromise, which shall form part of the decree.

Miscellaneous applications, if any pending, shall stand

closed. There shall be no order as to costs.
