COMMON JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)


1.    The appellants are aggrieved by an order dated 10.12.2019,

passed by the learned Single Judge disposing of W.P.No.26697 of

2019 filed by the respondent No.1/writ petitioner praying inter alia

for directions to the Government authorities to demolish the illegal

construction purportedly carried out by the appellants at plots No.616,

617, 634 and 635, Type B, situated in Sriram Nagar, Kondapur

Village, Serilingampally Mandal, Ranga Reddy District.

2. By the impugned order, the learned Single Judge has directed

the Deputy Commissioner, GHMC to decide the pending

representation dated 02.11.2019 submitted by the respondent

No.1/writ petitioner, raising a grievance against the purported

unauthorised construction raised by the appellants, after affording an

opportunity of hearing to both sides.

3. Mr. Ch. Laxminarayana, learned counsel for the appellants

states that the respondent No.1/writ petitioner did not reveal to the

court the fact that earlier hereto, he had filed W.P.No.8955 of 2019 for

seeking similar relief, which is still pending adjudication.

4. Mr. K. Gopal, learned counsel appearing on behalf of the

respondent No.1/writ petitioner concedes that the aforesaid writ

petition is pending and states that he has no objection, if the same is

disposed of by this court, in view of the order dated 10.12.2019

passed in W.P.No.26697 of 2019.

5. Learned counsel for the appellants is also agreeable to the said

suggestion.

6. Accordingly, the present appeal is disposed of while upholding

the order dated 10.12.2019 passed in W.P.No.26697 of 2019 and

disposing of W.P.No.8955 of 2019 filed by the respondent No.1/writ

petitioner and pending adjudication before the learned single Judge,

along with the pending applications, if any.
