THE HON'BLE THE CHIEF JUSTICE SATISH CHANDRA SHARMA
AND
THE HON'BLE SRI JUSTICE N. TUKARAMJI
I.A.No.1 of 2021 In/and W.A.No.664 of 2021
COMMON JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of the order
dated 14.02.2020 passed by the learned Single Judge in
W.P.No.3156 of 2020.
The facts of the case reveal that the judgment was
delivered by the learned Single Judge on 14.02.2020 and
with a delay of 603 days, the writ appeal has been filed.
Except for making a bald statement that on account
of COVID-19 pandemic, the writ appeal was not filed
within time, there is no explanation for the day-to-day
delay even after the lock down was lifted. There are no
minute details furnished by the appellant/Organisation.
Otherwise also, before the learned Single Judge, only an
interlocutory order of the Central Government Industrial
Tribunal was under challenge and the Tribunal is yet to
decide the matter on merits.
The parties will have all possible grounds to argue
before the Central Government Industrial Tribunal,
where the main matter is pending.

Resultantly, I.A.No.1 of 2021 is dismissed and the
writ appeal is rejected.
Miscellaneous petitions pending, if any, shall stand
closed. There shall be no order as to costs.
