WRIT PETITION No.16521 OF 2015

ORDER: (Per Hon'ble Sri Justice P.Naveen Rao)

Heard learned Government Pleader for Services appearing

for the petitioners and Sri K. Rama Subba Rao, learned counsel

appearing for respondent No.1.

2. Aggrieved by the order of termination as Home Guard,

respondent No.1 filed O.A.No.5395 of 2014 in the Andhra

Pradesh Administrative Tribunal, Hyderabad. Following the

earlier decisions of the Tribunal, the Tribunal by order dated

11.09.2014 allowed the said O.A. by setting aside the order of

removal as Home Guard, dated 19.12.1997. Aggrieved by the

same, the State preferred this writ petition.

3. During the course of hearing, learned Government Pleader

for Services appearing for the petitioners and learned counsel

appearing for respondent No.1 submit that the subject matter of

the writ petition is covered by the decision in W.P.No.35460 of

2013 and batch, dated 08.06.2018.

4. Following the said decision, dated 08.06.2018 in

W.P.No.35460 of 2013 and batch, this writ petition is also

dismissed. Having regard to inordinate delay in filing the O.A.

against termination and passing final orders in this writ petition

now, petitioners are entitled to conduct physical efficiency test to

respondent No.1 before considering the issue as per the

judgment of this Court. Miscellaneous Petitions, if any, pending

in this writ petition shall stand closed.
