JUDGMENT:     (Per the Hon'ble the Chief Justice Satish Chandra Sharma)



     The present Writ Appeal is arising out of the order

dated 26th August, 2021 passed by the learned single

Judge in Writ Petition No.4345 of 2021.


     The facts of the case are that the Writ Petition was

filed by the petitioner for inter Battalion transfer, and the

learned Single Judge has disposed of the Writ Petition

with a direction to the respondents to consider the

request of petitioner in the vacancies available.

In the considered opinion of this Court, as a

direction has been issued to consider the request in

vacancies available in terms of the Memorandum

dt.15.02.2021 in the above Writ Petition, no case for

interference is made out in the matter and the State is at

liberty to consider the request of petitioner in accordance

with Law.

With the aforesaid observations, the Writ Appeal is

disposed of. No order as to costs.
