Item No.40
THE HON'BLE THE CHIEF JUSTICE HIMA KOHLI
AND
THE HON'BLE SRI JUSTICE A. ABHISHEK REDDY
I.A.No.1 OF 2020 IN/AND W.A.No.167 OF 2020
JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)
1.
I.A.No.1 of 2020 has been moved by the appellants being
aggrieved by an interim order passed by the learned Single Judge in
W.P.No.34657 of 2012. The appellants seek condonation of delay of
2579 days in preferring the accompanying appeal.
2. The explanation offered by the appellants for the inordinate delay
is contained in para 4 of the application which, to say the least, is
extremely sketchy and does not offer either just or sufficient cause to
condone the delay.
3. At this stage, Mr. Deepak Bhattacharjee, learned Senior Counsel
appearing for the appellants states on instructions that instead of pressing
the present appeal, the appellants may be granted liberty to move an
application before the learned Single Judge in W.P.No.34657 of 2012 to
take up the writ petition for final hearing, as pleadings therein are
complete.
4. Leave, as prayed for, is granted. I.A.No.1 of 2020 and the writ
appeal are disposed of as not pressed along with the pending
applications, if any.
