ORDER

1. The instant appeals have been preferred under Rule 134 of
Rajasthan High Court Rules, 1952 read with Article 225 of the
Constitution of India against the judgments dated 14.02.2025,
17.02.2025, 03.03.2025, whereby the writ petitions filed by the

respondents challenging the transfer orders impugned therein,
were allowed and the said transfer orders were quashed and set
aside with liberty to pass fresh orders, if occasion so arises.
2. The respondents (writ petitioners), being Skilled, Semi-
skilled and Unskilled staff members of the appellants-Power
Distribution Company, had challenged the mass transfer orders
issued by the appellants. The writ petitions were disposed of on
the following terms:
"15. In the premise, the impugned transfer orders of the
petitioners, who are stated to be the staff members either
belonging to unskilled/semi-skilled and/or skilled (Category 'A' or
'B') have been transferred, are set aside, with liberty to pass
fresh orders. Endeavor shall be made to keep them within the
same division, subject of course to the administrative exigencies
at the place to be determined at the discretion of the competent
authority.
16. Before parting, I may hasten to add that it is not for this
Court to substitute its own discretion to determine the work
exigencies as has been argued on behalf of the petitioners,
asserting that they should be allowed to continue on the same
post at same place, since their transfers are not caused by any
existing administrative exigency and/or are not in the interest of
Discom. The said decision is, left open to the administrative
experts. However, such work exigencies must be balanced
against employee rights and service rules vis-à-vis humanitarian
considerations in deserving cases, upon due verification thereof.
Fresh transfer orders, wherever warranted, shall thus be passed
only after considering administrative necessity/discom interest
while ensuring employees remain within their sub division/
division, as per their respective seniority being maintained.
17. All the writ petitions stand disposed of accordingly."
3. Mr. Ravi Bhansali, learned Senior Counsel assisted by
Mr.Bhavit Sharma ; Mr. Manoj Bhandari, learned Senior Counsel
assisted by Mr. Shubham Modi, appearing on behalf of the
appellants, submit that they are not averse to the transfers having
been set aside at that juncture, as sufficient liberty has already
been granted by the learned Single Bench to pass fresh transfer

orders in administrative exigency, but the only issue which they
are agitating is the condition imposed by learned Single Bench
that if any fresh transfer is made in administrative exigency, it
shall be ensured that the employees remain within their respective
sub-division and division as per their seniority being maintained.
4. Learned counsel for the respondents, at length, submit that
there has been an established procedure, practice and
understanding, which have been arrived at through various policy
decisions, having been duly considered by the learned Single
Bench.
5. Heard learned counsel for the parties and perused the
material available on record.
6. This Court is of the firm opinion that today the appellants'
role in the operations has completely transformed; the department
is now operating as a Company and competitive functionality in
the essential function of electricity supply is being rendered.
Transfer is a matter of administrative exigency and policies
regarding transfers are subject to change. The undisputed fact is
that the latest Transfer Policy dated 16.03.2018 is presently in
vogue and has to be adhered to by the appellants.
7. Learned Senior Counsel for the appellants have also
informed that appropriate amendments in the regulations
presently do not require the seniority list to have any impact, as
time-bound promotions are taking place in the cadre of Technical
Helper.

8. Thus, without interfering with the judgments passed by the
learned Single Bench to the extent that all the transfer orders
under challenge were set aside and liberty was granted to the
appellants to pass fresh orders, the same is upheld. However, the
portion of the judgment, which requires the appellants to restrict
the movement of employees outside their division, is hereby
quashed and set aside. The appellants shall have complete
discretion to effect transfers in administrative exigency, while
taking into consideration the latest policy in force, which at
present is dated 16.03.2018.
9. The instant appeals stands disposed of accordingly. All
pending applications, if any, also stand disposed of.
