Order

1. Learned counsel for the petitioner submits that the
controversy raised in the present writ petition is identical to the
issue raised in earlier writ petition being S.B. Civil Writ Petition
No.18402/2024; Harendra Pal Singh vs. The Union of India
(decided on 20.01.2025) wherein a Co-ordinate Bench of this
Court passed the following order:-
"5. It is to be noted that while allowing petitioner's writ petition on 09.10.2024, this Court had directed the respondents to issue passport to the petitioner ignoring the pending protest proceedings. The order contained no stipulation about the curtailment or otherwise of the period of passport.

6. Such being the position, it was incumbent upon the respondent to issue the passport for a period of ten years which is usually issued unless the Court itself confines or reduces the life of the passport - it is not open for the Passport Officer to issue the passport for a limited period.
7. The present writ petition is thus, allowed.
8. The petitioner to produce a certified copy of the order instant alongwith the representation and application for re-issuance of passport within a period of 15 days from today; whereafter the Passport Officer shall issue a passport with a validity of 10 years within a period of 7 days.
9. Stay application also stands dispose of, accordingly."
2. Learned counsel for the petitioner submits that a writ
petition, being S.B. Civil Writ Petition No. 15281/2024, was filed
as he was denied a passport on account of the registration of a
criminal case. The said petition was allowed by this Court on
18.11.2024. Later, the petitioner was issued passport but for brief
period of one year. Learned counsel further submits that, as far as
the criminal case is concerned, the same is not pending as on
date, as the police, after investigation, have recommended a final
negative report. That being so, the regular passport may be issued
to the petitioner.
3. In view of the submissions made above and considering the
judgment passed in the case of Harendra Pal Singh (supra),
learned counsel for the petitioner prays that the present writ
petition may also be disposed of in the same terms.

4. Learned counsel appearing for the State Authorities do not
object the submissions made by learned counsel for the petitioner.
5. In view of the submission made above, the instant writ
petition is disposed of in the same terms as Harendra Pal Singh
(supra).
6. Pending application(s), if any, stand(s) disposed of.
