The present petition is filed for quashing of condition

regarding deposition of 20% of the amount of compensation as

directed in the order dated 11.09.2024, passed by District and

Session Judge, Jhunjunu, Rajasthan, in Criminal Appeal No.

53/2024 while suspending the sentence awarded in judgment

dated 13.08.2024 passed by the Additional Chief Judicial

Magistrate, Udaipurwati, District Jhunjunu wherein, the petitioner

was convicted for offence under section 138 of NI Act and

sentenced with a simple imprisonment of one year six months

with find of Rs. 23,50,000/- in default of which the petitioner shall

undergo further imprisonment of five months.

Learned counsel for the petitioner has submitted that

petitioner is suffering from severe financial hardships.

Vide Annexure-3, i.e. order dated 11.09.2024, learned Trial

Court had granted 30 days time to deposit the 20% amount of the

compensation, which is contrary to the mandate which provide 60

days time.

This Court is disposing of the present petition, by directing

that above said order passed by the learned Trial Court be

modified and time period of 30 days be read as 60 days for

depositing the said compensation amount.

Accordingly, present petition is disposed of. Pending

applications, if any, shall stand disposed of.
