For the reasons stated in the restoration application (SB

Criminal Misc. Application No.715/2023), the same is allowed

subject to cost of ₹1,500/-.

The orders dated 18.09.2023 passed by this Court & dated

13.10.2023 passed by the Registrar (Judl.) are recalled. The SB

Criminal Miscellaneous Petition No.5786/2019 shall stand restored

to its original number provided the order dated 18.09.2023 passed

therein is complied with and the aforesaid cost is deposited by the

applicant/petitioner with the Litigants Welfare Fund within a period

of two weeks from today failing which this order shall stand

recalled and the restoration application shall stand dismissed

without reference to the Court.
